Buyer / Consumer: any natural person acting for purposes outside their commercial, industrial, production, artisanal or liberal activity.

Customer: any natural or legal person who places an order on the website backstage-shop.ro.

Website: the online store accessible at backstage-shop.ro.

Order: an electronic document transmitted through the Website, by which the Customer expresses their intention to purchase products from the Seller.

Distance contract: the contract concluded between the Seller and the Customer, without simultaneous physical presence, exclusively through means of distance communication (art. 2 pt. 7, GEO 34/2014).

Product: any audio, video, lighting, stage technology, smart systems equipment or accessory marketed through the Website.

These general conditions govern the contractual relationship between S.C. BACKSTAGE PRODUCTION GROUP INTERNATIONAL S.R.L. and its Customers, within the framework of distance contracts concluded through the backstage-shop.ro online store.

By placing an order on the Website, the Customer declares that they have read, understood and fully accept these general conditions.

The Seller reserves the right to modify these conditions, with modifications entering into force upon publication on the Website. Contracts in progress are subject to the conditions valid at the time the order was placed.

backstage-shop.ro markets professional equipment for event productions, including but not limited to:

Audio equipment: active/passive speakers, mixers, audio processors, amplifiers (QSC, etc.)

Video equipment: PTZ cameras, video processors, displays, video walls (Panasonic, Q-SYS, etc.)

Lighting equipment: moving heads, LED projectors, strobes, blinders (Chauvet, etc.)

Stage technology: scaffolding, trusses, modular structures (Eurotruss, etc.)

Smart systems: integrated audio-video solutions, automation

Related accessories and consumables

All products are new, original, marketed with a legal conformity guarantee and, where applicable, a commercial guarantee granted by the manufacturer.

All prices displayed on the Website are expressed in Lei (RON) and include VAT (21%), in accordance with the legislation in force.

By way of exception, the order is exempt from VAT for intra-community deliveries to legal entities holding a valid VAT number, verified in the VIES system (reverse charge), as well as for deliveries outside the European Union. In such cases, VAT is deducted from the displayed prices, and the payable total, the order summary and the invoice are expressed without VAT.

Prices are valid at the time the order is placed. The Seller reserves the right to change prices at any time, without prior notice, but these changes will not affect orders already confirmed.

The product price does not include delivery costs, which will be communicated separately before completing the order.

The Customer can pay for the order through the following methods:

Online payment by card (Visa, Mastercard) - secure processing through Netopia Payments

Bank transfer to the Seller's account

Orders exceeding the highest value covered by the shipping grid cannot be paid online by card when the order is placed; they are completed after our team contacts the Customer, and payment is made by bank transfer or by card, at the Customer's choice (card payment requires a customer account on the website).

An order may only be placed if the value of the products exceeds the minimum threshold communicated by the Seller. The threshold is displayed on each product page, in the «Shipping & delivery details» section, as well as in the order summary, before the order is completed.

In accordance with Art. 8 of Law 365/2002 and Art. 8 of GEO 34/2014, the technical steps for concluding the contract are:

1. The Customer browses the Website and selects the desired products, adding them to the shopping cart.

2. The Customer accesses the shopping cart and verifies the selected products, quantities and prices.

3. The Customer fills in the delivery and billing data.

4. The Customer selects the order currency and the payment method.

5. The Customer verifies the order summary (products, quantities, total price, delivery costs, billing data).

6. The Customer confirms the order by pressing the 'Order with payment obligation' button (in accordance with Art. 8 para. 2, GEO 34/2014).

7. The Seller sends the Customer an order confirmation email, on a durable medium, containing all pre-contractual information.

The distance contract is considered concluded upon the Customer's receipt of the order confirmation email (Art. 8 para. 9, GEO 34/2014).

During the ordering process, the Customer has the ability to identify and correct errors in data entry, before final confirmation.

The contract can be concluded in Romanian or English, depending on the language selected on the Website.

In accordance with Art. 9-16 of GEO 34/2014, the Consumer has a period of 14 calendar days to withdraw from the distance contract, without having to justify the decision and without bearing any costs other than those provided by law.

The 14-day period starts from the date on which the Consumer or a third party (other than the carrier) takes physical possession of the products.

To exercise the right of withdrawal, the Consumer will inform us through an unequivocal statement (letter sent by post, email to contact@backstage.ro or by completing the withdrawal form available on the Website).

The direct cost of returning the products is borne by the Consumer (Art. 14 para. 2 of GEO 34/2014). The products may be shipped by courier, at the Consumer's choice and expense, or handed over in person at the Seller's headquarters, in which case no shipping cost is charged. For products which, by their very nature, cannot normally be returned by post (bulky or heavy equipment), the return cost depends on size, weight and location; the Seller communicates an estimate of this cost to the Consumer before the order is placed, at contact@backstage.ro or +40 726 314 538.

The Seller shall reimburse all amounts received from the Consumer, including standard delivery costs, within a maximum of 14 days from the date on which it is informed of the withdrawal decision (Art. 13 of GEO 34/2014). If the Consumer has expressly chosen a delivery method more expensive than the standard one offered by the Seller, the supplementary costs are not reimbursed.

This section does not apply to non-conforming products. In the case of defective products, all return, shipping, labour and material costs are borne by the Seller, under the legal guarantee of conformity (GEO 140/2021) — see the 'Warranty Policy' section.

The standard withdrawal form (in accordance with the Annex, Part B, of GEO 34/2014) is available on the Website, on the "Withdrawal / Return Form" page.

The maximum delivery term is 30 calendar days from the date the contract is concluded, in accordance with Art. 18 para. 1 of GEO 34/2014, except where the parties have agreed on a different term.

For orders paid by bank transfer, as well as for those completed after our team contacts the Customer, the delivery cost cannot be calculated automatically when the order is placed; it is determined individually, depending on the specifics of the order, is communicated to the Customer before payment is made, and is borne by the Customer.

All marketed products benefit from the legal conformity guarantee in accordance with the legislation in force.

S.C. BACKSTAGE PRODUCTION GROUP INTERNATIONAL S.R.L. makes every effort to ensure the accuracy of information presented on the Website, but does not guarantee that the Website will operate without interruptions or errors.

The Seller shall not be liable for any price errors appearing on the Website due to technical malfunctions. If a product is listed at an erroneous price, the Seller will inform the Customer and offer the option to continue the order at the correct price or to cancel it.

Neither party shall be liable for failure to fulfill contractual obligations if this is caused by a force majeure event, as defined by the Civil Code.

All content on the backstage-shop.ro Website (texts, images, graphics, logos, design elements, software) is the property of S.C. BACKSTAGE PRODUCTION GROUP INTERNATIONAL S.R.L. or its suppliers and is protected by copyright and related rights legislation.

Reproduction, distribution or use for any commercial purpose, without prior written consent, is prohibited.

The Seller processes the personal data of Customers in accordance with Regulation (EU) 2016/679 (GDPR).

In case of disagreements between the parties, they will attempt to resolve them amicably.

The Consumer may file a complaint with the National Authority for Consumer Protection (ANPC): https://anpc.ro

The Consumer may use the European Online Dispute Resolution (ODR) platform, in accordance with Regulation (EU) No. 524/2013: https://ec.europa.eu/consumers/odr

If the dispute cannot be resolved amicably or out of court, it will be submitted to the competent courts in Romania.

These conditions are governed by Romanian law.

The main applicable legal acts are: Law 365/2002 on electronic commerce, GEO 34/2014 on consumer rights, the Civil Code, Regulation (EU) 2016/679 (GDPR).
